Court Upholds Entitlement Under MACP Scheme, Citing Violation of Constitutional Rights
In a significant judgment, the Jharkhand High Court has quashed the arbitrary denial of Modified Assured Career Progression (MACP) benefits to a government employee, Shailesh Kumar Singh, citing a violation of Article 14 of the Constitution of India. The petitioner, who served as a clerk, was denied the benefits of the 3rd MACP in the Grade Pay of Rs. 4800, which he was entitled to upon completing 30 years of service.
The court, presided over by Justice Deepak Roshan, found that the denial of benefits was discriminatory, given that similarly situated employees in the South Chotanagpur Division had been granted the same benefits. The petitioner, initially posted in South Chotanagpur Division, was later transferred to Kolhan Division following the bifurcation, which led to the denial of his rightful benefits.
In its judgment, the court emphasized that the merger of pay scales has no bearing on entitlement under the MACP Scheme. The court highlighted that the administrative order rejecting the petitioner’s claim was cryptic and lacked any valid reasoning. It reiterated the established legal principle that reasons for administrative decisions must be clearly articulated in the order itself and cannot be supplemented by counter affidavits.
The court directed the state respondents to extend the benefits of the 3rd MACP to the petitioner with Grade Pay of Rs. 4800, effective from September 1, 2008, along with all consequential benefits. The court ordered that the difference in the amount payable be disbursed within eight weeks, failing which an interest of 6% per annum would apply.
This judgment underscores the importance of transparency and equality in administrative decisions and sets a precedent for similar cases where employees face arbitrary denial of benefits due to technicalities or administrative oversight.
