Court Finds No Grounds for Charges Under IPC Sections 188, 506, and RPA Section 125 Against Jharkhand Chief Minister
In a significant legal development, the Jharkhand High Court has quashed the criminal proceedings against Hemant Soren, the Chief Minister of Jharkhand, in a case involving allegations under Sections 188 and 506 of the Indian Penal Code (IPC) and Section 125 of the Representation of the People Act, 1951. The proceedings stemmed from an FIR alleging violation of the model code of conduct during an election campaign speech in 2014.
Presiding over the case, Justice Anil Kumar Choudhary concluded that the essential legal prerequisites for the charges were not satisfied. The court noted the absence of a written complaint by the public servant whose authority was allegedly disobeyed, as mandated by Section 195 of the Code of Criminal Procedure (CrPC), thereby nullifying the basis for prosecution under Section 188 IPC. Furthermore, the court found no evidence of criminal intimidation under Section 506 IPC, as there were no threats made with the intent to cause alarm.
Regarding the charge under Section 125 of the Representation of the People Act, the court determined that Soren's statements, which expressed criticism over potential legislative amendments, did not amount to promoting enmity or hatred among different classes of citizens. The court emphasized that none of the charges justified the continuation of proceedings, deeming it an abuse of the legal process.
This ruling underscores the importance of adhering to statutory requirements in criminal prosecutions and reiterates the judicial safeguards against misuse of legal proceedings for political ends. The decision effectively sets aside prior orders by lower courts that had taken cognizance of the charges.
Bottom line:-
Quashing of criminal proceedings due to non-compliance with mandatory provisions under Section 195 CrPC for cognizance of offences under Section 188 IPC, lack of essential ingredients for offences under Section 506 IPC and Section 125 of the Representation of the People Act, 1951.
Statutory provision(s): Section 195 CrPC, Section 188 IPC, Section 506 IPC, Section 125 of the Representation of the People Act, 1951.
