Court Orders Reinstatement with 50% Back Wages for Peon Dismissed Over Minor Office Infraction


In a significant ruling, the Jharkhand High Court has set aside the termination of Ranjeet Kumar Himanshu, a contractual peon with the District Rural Development Agency (DRDA), Government of Jharkhand, Bokaro. The court found that the termination, which followed a vague show-cause notice regarding the alleged misuse of office materials, violated the principles of natural justice.


Ranjeet Kumar Himanshu, who served as a peon for 17 years, was dismissed in May 2022 following allegations that he had taken office materials, purportedly tea and biscuits, to his home. The court observed that the show-cause notice served to Himanshu was insufficiently detailed, failing to specify the exact nature of the materials involved or the extent of the alleged misuse.


The bench, comprising Chief Justice M. S. Sonak and Justice Rajesh Shankar, highlighted the lack of a reasoned termination order, noting that Himanshu's response, which emphasized his long service and the potential hardship to his family, was not adequately considered. The court underscored the disproportionate nature of the penalty, stating that dismissal for such a minor infraction was excessive and "shocks the conscience."


In a detailed judgment, the court ordered the reinstatement of Himanshu by July 1, 2026, with 50% back wages to be paid by July 31, 2026. The decision mandates the Deputy Commissioner and Deputy Development Commissioner of Bokaro to ensure compliance and submit affidavits confirming the execution of the order.


This ruling reaffirms the judiciary's commitment to upholding the principles of natural justice and proportionality in employment matters, particularly concerning contractual employees.
