Kerala High Court Directs Clarification and Notification of Anti-Ragging Guidelines; Legislative Amendments on Punishment Pending

Court orders immediate notification of revised Anti-Ragging and Student Welfare Guidelines 2026 with clarified terminology, while deferring enhancement of punishments to legislative amendment of Kerala Prohibition of Ragging Act, 1998

In a significant development concerning student welfare and anti-ragging measures, the Kerala High Court (Division Bench) on October 6, 2026, addressed the pending amendments to the Kerala Prohibition of Ragging Act, 1998, in light of the proposed Anti-Ragging and Student Welfare Guidelines, 2026. The case, initiated by the Kerala State Legal Services Authority (KeLSA) through W.P.(C) No. 8600 of 2025, sought judicial intervention on certain contentious provisions of the proposed Guidelines and the Act itself.

The Court acknowledged the comprehensive efforts of the Committee constituted by the Government of Kerala on July 20, 2026, to formulate the Guidelines aimed at curbing ragging within educational institutions. However, the Kerala State Legal Services Authority raised concerns regarding the clarity of language used in Clause 6 of the Guidelines, which presently reads "within, or without, any educational institution." KeLSA advocated for replacing this phrase with "within or outside, any educational institution," to eliminate ambiguity surrounding the spatial scope of anti-ragging enforcement.

During the hearing, Ms. Parvathi A. Menon, Advocate for KeLSA, underscored the necessity of this linguistic modification alongside suggestions for enhancing punishments for ragging offenses and reclassifying the offense as cognizable and non-bailable. The latter proposals aimed at strengthening deterrence against ragging incidents.

Responding to these submissions, the learned Advocate General for the State of Kerala conceded to the modification of Clause 6's expression to the clearer "within or outside" formulation. However, he firmly stated that proposals for increasing punishments and reclassification of the offense cannot be effected through Guidelines alone. Such changes mandate a formal amendment to Section 4 of the Kerala Prohibition of Ragging Act, 1998, which remains under legislative consideration.

The Division Bench, comprising Chief Justice Soumen Sen and Justice C. Jayachandran, directed the State Government to notify the amended Guidelines incorporating the clarified terminology within two weeks. The Court expressed confidence that the legislature would duly consider the substantive concerns raised by KeLSA, including the enhancement of penalties and reclassification, during the finalisation of the Bill to amend the Act.

The matter was adjourned to December 2, 2026, to monitor progress on the statutory amendments and implementation of the Guidelines.

This ruling highlights the judiciary's proactive approach in ensuring immediate enforceability of anti-ragging measures while respecting the constitutional prerogative of the legislature to enact substantive changes to criminal law provisions. It also reflects the collaborative efforts between the legal services authority, government, and judiciary to combat ragging, a persistent menace affecting students' safety and dignity.

Bottom Line:

Kerala Prohibition of Ragging Act, 1998 - Proposed Anti-Ragging and Student Welfare Guidelines, 2026 - High Court directed that till legislation is made, Guidelines be followed and notified within two weeks - Expression in Clause 6 clarified by substituting "within, or without, any educational institution" with "within or outside, any educational institution" - Questions relating to enhancement of punishment and reclassification of offence as cognizable and non-bailable held to require statutory amendment and not mere incorporation in Guidelines.
