Court Issues Directions to Address Overcrowding and Enhance Legal Support for Eligible Inmates


In a significant move, the Kerala High Court has issued comprehensive directions to ensure effective legal aid for prisoners seeking premature release or remission of their sentences. The judgment came in response to multiple petitions, including those filed by individuals and one suo motu petition, highlighting the need for improved legal assistance and prison conditions in Kerala.


The court, presided over by Chief Justice Soumen Sen and Justice Syam Kumar V.M., emphasized the need for coordination between the Kerala State Legal Services Authority (KeLSA), District Legal Services Authorities (DLSAs), and prison officials to facilitate timely processing of applications for remission or premature release. The judgment mandates the identification of eligible prisoners who have not yet applied for such relief, provision of legal aid for application submission, and assistance in challenging rejections where legally sustainable.


The judgment also addresses the dire issue of overcrowding in prisons, directing the State and Union of India to explore measures for improving prison conditions and managing transit homes for prisoners. The Foreigners Regional Registration Officer (FRRO) and the Union of India have been impleaded as additional respondents to address issues related to transit homes.


The court took note of a compliance report from KeLSA, which highlighted the current status of life convicts and their eligibility for premature release. It underscored the importance of adhering to the National Legal Services Authority's (NALSA) Standard Operating Procedures (SOP) and Supreme Court guidelines for the timely disposal of applications.


The bench has scheduled the next hearing for July 27, 2026, and has requested further reports on the progress of legal aid implementation and prison management improvements.
