Court Allows Withdrawal of Illegal Municipal Order, Directs Fresh Proceedings and Recovery of Costs from Responsible Officer to Protect Public Exchequer
In a significant judgment dated October 28, 2026, the Madhya Pradesh High Court, Indore Bench, presided over by Justice Sandeep N. Bhatt, dealt with a writ petition filed by M/s Bafgna Hospital and Orthopedics Research Centre Pvt Ltd challenging an order issued by the Indore Municipal Corporation. The order, dated September 30, 2026, along with a subsequent ledger report, was found to be legally unsustainable as it relied on statutory provisions-Sections 143, 146, and 153 of the Municipal Corporation Act-that were omitted in 2020.
During the hearing, senior counsel for the Municipal Corporation, after arguments, admitted the order was bad in law and agreed to treat the impugned order and ledger report as withdrawn. Despite this concession, the Court expressed its displeasure over the mechanical and ignorant exercise of jurisdiction by the municipal officer, emphasizing the officer's duty to adjudicate strictly within the existing legal framework.
The Court highlighted that such negligence leads to wastage of precious judicial time and erodes public trust in statutory authorities. To deter future lapses, the Court imposed an exemplary cost of Rs. 1,00,000 on the erring officer. Of this, Rs. 75,000 was directed to be deposited with the M.P. Legal Services Authority, Indore, and Rs. 25,000 to be paid to the petitioner as litigation costs. Importantly, the Court ordered that this cost should be recovered from the erring officer personally, and not borne by the Municipal Corporation or the public exchequer.
The judgment permits the Municipal Corporation to initiate fresh proceedings strictly in accordance with law. The petitioner is also at liberty to raise all available contentions during such proceedings. The Court cautioned that future adjudications must be conducted with proper application of mind and adherence to statutory provisions.
This ruling underscores the judiciary's intolerance towards procedural negligence by statutory bodies and reinforces the principle that public authorities must act within the confines of the law while safeguarding public resources.
Bottom Line:
Municipal Corporation withdrew an impugned order and ledger report as non-est after admitting that the order was bad in law, having been passed by relying on omitted provisions of the Municipal Corporation Act. High Court imposed exemplary costs for non-application of mind and directed recovery of the amount from the erring officer instead of burdening the public exchequer.
