Court Upholds Constitutional Mandate of Equal Opportunity, Rejects Permanent Absorption of Temporary Staff
In a significant ruling, the Madras High Court has denied the claims for regularisation and permanent absorption made by temporary Steno-Typists, Typists, and Junior Assistants serving in the District Judiciary across Tamil Nadu. The bench, comprising Justices S.M. Subramaniam and N. Senthilkumar, ruled that the temporary appointments under Rule 16(e)(i) of the Tamil Nadu Judicial Ministerial Service Rules do not confer any right to claim regularisation or permanent absorption. The court highlighted that accepting the terms of temporary service precludes any claim for permanency without undergoing the regular recruitment process.
The judgment referred to the legal principles established by the Constitution Bench in the landmark case of State of Karnataka v. Uma Devi, which prohibits regularisation of employees appointed irregularly or through back-door methods. The court reiterated that such appointments violate the principles of equal opportunity enshrined in Articles 14 and 16 of the Constitution.
The court also addressed the administrative exigencies highlighted by the Judicial Department, which necessitated temporary appointments to manage the workload and ensure smooth functioning of the judiciary. However, the court emphasized the need for the Judicial Department to create sanctioned posts and conduct regular recruitment processes to prevent indefinite continuation of temporary appointments.
In its order, the court directed that future recruitment notifications should allow currently serving temporary employees and those terminated to participate in the selection process, provided they meet eligibility criteria, with possible age relaxation.
This ruling underscores the judiciary's commitment to maintaining transparency and fairness in public employment, ensuring that all eligible candidates have an equal opportunity to compete for government positions.
