Court Orders Shared Electricity Liability Be Split Among Multiple Offices Using Common Connection
In a significant ruling, the Madurai Bench of the Madras High Court has directed the installation of separate electricity service connections for various offices operating within the Pudukottai court complex. The decision comes in response to a writ petition filed by the Pudukottai Bar Association, which contested a demand for electricity charges amounting to Rs. 22,40,665. The petitioner argued that the charges were unjustly imposed solely on the Bar Association, despite the shared use of the electricity connection by multiple government offices, including the Public Prosecutor's Office and the Government Pleader's Office.
Justice M. Dhandapani, presiding over the case, acknowledged the unfairness of holding the Bar Association solely accountable for the entire electricity liability. A court-mandated inspection corroborated the petitioner's claim, revealing that the electricity connection was indeed shared by several government offices on the court premises.
The court's order, dated July 15, 2026, mandates the Bar Association to make a partial payment of Rs. 7,50,000 within eight weeks. Furthermore, the Tamil Nadu Electricity Board has been instructed to expedite the process of installing individual service connections and meters for each office utilizing the current shared connection. This will ensure that future electricity bills accurately reflect the consumption of each office, thereby distributing the financial burden equitably.
This decision underscores the importance of fairness in the allocation of utility liabilities among multiple occupants sharing a single service connection. It also sets a precedent for similar cases where common facilities are shared among distinct entities.
