Unauthorized Constructions to be Demolished; Interim Use to Maintain Community Hall Status
In a landmark decision, the Madras High Court has set aside an earlier order concerning the disputed use of land in the VGP Golden Beach Layout in Injambakkam Village. The court directed a fresh examination of the land earmarked for a community hall, amidst controversies involving its conversion into a restaurant and a church.
Presiding over the case, Justice M. Dhandapani emphasized the necessity of adhering to the Tamil Nadu Town and Country Planning Act, 1971, which stipulates that land designated for specific public purposes in approved layouts cannot be repurposed without proper authorization. The judgment highlighted the absence of necessary permissions for the existing constructions on the site, notably a restaurant and a church, both unauthorized under the current layout plan.
The petitioner, Injambakkam VGP Layout Owners Association, argued that the layout promoter, VGP Housing Pvt. Ltd., had violated the terms of the layout approval by converting the community hall into commercial establishments. The court acknowledged these concerns, referencing previous judicial findings that land reserved for public amenities cannot be altered for other uses.
In its ruling, the court directed the Regional Deputy Commissioner (South) to determine the nature of the land and decide if it qualifies as an Open Space Reserve (OSR). Pending this decision, the land must retain its designation as a community hall, prohibiting any other use. Additionally, the court mandated the Greater Chennai Corporation to ensure the eviction of the restaurant and the demolition of the church, which were erected without requisite permissions.
The court further instructed that any financial proceeds from the interim use of the community hall be held in a separate account, pending the final decision on the land's status. This decision underscores the court's commitment to uphold the principles of natural justice and statutory compliance in land use and planning.
Bottom Line :
Land earmarked for a specific purpose in an approved layout cannot be converted for other uses unless explicitly determined by the competent authority. Principles of natural justice must be adhered to during such determinations.
Statutory provision(s): Tamil Nadu Town and Country Planning Act, 1971, Sections 2(2), 2(22), 2(31), 2(36); Principles of Natural Justice.
