Allahabad High Court Upholds Typing Test as Essential Criterion for Promotion to Junior Assistant

Court Dismisses Petition Challenging Typing Test Requirement for Group C Promotions under 2014 Rules

In a significant ruling, the Allahabad High Court, presided over by Justice Anish Kumar Gupta, has upheld the necessity of a typing test as an essential eligibility criterion for promotion to the position of Junior Assistant in the state of Uttar Pradesh. The court dismissed a writ petition filed by Ashok Kumar and others, which challenged the procedural validity of the typing test conducted before the written examination and interview.

The petitioners, who were confirmed employees in Class-IV positions at the Gorakhpur Collectorate, contended that the typing test should have been conducted after the written test and interview, as per the Uttar Pradesh Subordinate Offices Ministerial Group "C" Posts of the Lowest Grade (Recruitment by Promotion) Rules, 2001. However, the court clarified that the typing speed requirement is a prerequisite, as per the U.P. Government Departmental Ministerial Cadre Service Rules, 2014, which have superseded the 2001 rules.

Justice Gupta highlighted that Rule 10 of the 2014 Rules mandates a minimum typing speed of 25 words per minute in Hindi and 30 words per minute in English as essential qualifications for the Junior Assistant post. The court further noted that the 2014 Rules necessitate the assessment of typing skills before considering candidates for written tests and interviews.

The petitioners argued that the typing test was conducted prematurely, causing them to fail the selection process. However, the court found no illegality in conducting the typing test first, as it is an integral part of assessing the eligibility for promotion.

The court also dismissed the reliance on previous judgments cited by the petitioners, which were based on pre-2014 rules, asserting that those precedents did not consider the impact of the 2014 Rules.

The judgment underscores the importance of adhering to updated regulatory frameworks in promotion processes and reinforces the typing test as a critical component for positions requiring such skills. As a result, the petition was dismissed, affirming the promotions of candidates who met the stipulated typing speed criteria and other selection requirements.

Bottom Line :

Promotion eligibility for Junior Assistant post under 2001 and 2014 Rules clarified. Typing speed of 25 words per minute in Hindi is an essential qualification for promotion.
