Court Rules Inclusion in Promotion Panel Does Not Grant Absolute Right to Promotion if Disciplinary Proceedings Are Pending
In a significant ruling, the Madras High Court's Division Bench, comprising Justices S.M. Subramaniam and N. Senthilkumar, has set aside a writ order permitting a government official's promotion despite pending disciplinary proceedings. The court reiterated that inclusion in a promotion panel does not guarantee a right to promotion if disciplinary charges are pending.
The case involved V.A. Anand, a Deputy Inspector General of Registration, who was poised for promotion to Additional Inspector General. Despite being included in the promotion panel, his promotion was deferred due to disciplinary proceedings initiated over corruption allegations. The government cited G.O.Ms.No. 45, which barred Anand's promotion while the Tribunal for Disciplinary Proceedings in Coimbatore reviewed the charges.
The court emphasized that promotion is not an absolute right but a privilege contingent on a clean service record. It upheld that disciplinary proceedings under Rule 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules preclude promotion, aligning with the Tamil Nadu Government Servants (Conditions of Service) Act, 2016.
This judgment underscores the procedural nature of promotion panels, clarifying that they do not equate to actual promotions, especially when disciplinary actions are involved.
