Court Dismisses Union of India's Petition to Quash CAT Order, Affirms Entitlement of Financial Upgrades for Veena Dhoundiyal
In a significant judgment, the Meghalaya High Court has affirmed the financial upgradations granted under the Modified Assured Career Progression (MACP) Scheme to Smti. Veena Dhoundiyal, representing her late husband, Ramesh Chandra. The court's decision came as a dismissal of the Union of India's petition seeking to overturn the Central Administrative Tribunal (CAT) order that extended these benefits.
The case revolved around the interpretation of the ACP and MACP Schemes concerning the appointment of Ramesh Chandra as Hindi Officer following the abolition of the Hindi Instructor post. The Union of India argued that the appointment should be considered a promotion, thus affecting the financial upgradations. However, the court clarified that the post of Hindi Instructor was not a feeder cadre for the Hindi Officer position, and both posts carried the same grade pay due to the merger of pay scales under the 6th Central Pay Commission.
The court upheld the CAT's order, which granted the first financial upgradation in the grade pay of Rs. 6600/- effective from September 1, 2008, the second in the grade pay of Rs. 7600/- from the same date, and the third upgradation in the grade pay of Rs. 8700/- from November 14, 2014, after 30 years of regular service. The judgment emphasized that the respondent was entitled to these upgradations as the Hindi Officer post did not constitute a promotion from the Hindi Instructor role.
In delivering the judgment, the bench, comprising Chief Justice Mrs. Revati Mohite Dere and Justice W. Diengdoh, stated that the Union of India failed to provide substantial grounds to set aside the CAT's decision. The court's ruling reinforces the principles of the MACP Scheme, ensuring that employees are duly compensated for their service tenure and are not unjustly denied financial advancements.
