Court holds that request for extension of voluntary retirement date amounts to withdrawal under Rajasthan Civil Services (Pension) Rules, 1996; reinstatement relief set aside for lack of specific prayer.
In a significant decision dated October 3, 2026, the Rajasthan High Court (Division Bench, Jaipur) clarified the scope of voluntary retirement under Rule 50 of the Rajasthan Civil Services (Pension) Rules, 1996, holding that a government servant who has given notice for voluntary retirement may withdraw such notice before the intended date of retirement, subject to acceptance by the competent authority.
The judgment arose from a writ petition filed by H.K. Meena, a government employee who sought voluntary retirement initially from January 14, 2014, which was rejected due to non-compliance with the mandatory 90-day notice period. Subsequently, Meena applied for voluntary retirement effective July 31, 2014, but faced objections relating to a pending departmental enquiry. After obtaining an extension allowing him to continue service until October 31, 2014, Meena sought a further extension on October 29, 2014, citing improving health. The State Government, however, rejected this application and retired Meena effective October 31, 2014.
Meena challenged the retirement order, and a Single Judge quashed the retirement order and directed reinstatement, but limited benefits such as salary and seniority during the intervening period. Both Meena and the State Government appealed the order.
The Division Bench analyzed Rule 50 in detail, which governs voluntary retirement after completion of 15 years of qualifying service. The rule mandates a minimum three-month notice to the appointing authority and requires acceptance for retirement to become effective. The Court emphasized that voluntary retirement is an option available to government servants, and because acceptance is necessary, the retirement does not become effective merely on giving notice. Hence, the employee retains the right to withdraw the notice before the intended date with the approval of the competent authority.
The Court referred to a Constitution Bench decision of the Supreme Court in Union of India v. Gopal Chandra Misra (AIR 1978 SC 694), which held that a prospective resignation or voluntary retirement can be withdrawn anytime before it becomes effective, absent any legal bar. It held that a communication seeking extension of the retirement date is tantamount to withdrawal of the earlier voluntary retirement notice, demonstrating the employee's clear intention to continue in service.
The Court noted that although the Rajasthan Civil Services (Pension) Rules do not explicitly provide for extension of voluntary retirement dates, the absence of such a provision does not prohibit the competent authority from considering such requests, especially when made before the effective date of retirement.
Accordingly, the Division Bench upheld the quashing of the retirement order dated October 30, 2014, on the ground that Meena's request for extension constituted a withdrawal of his voluntary retirement notice. However, it modified the Single Judge's order to set aside the direction for reinstatement since Meena had not specifically prayed for reinstatement relief in his writ petition. The Court stressed that courts should not grant relief beyond what is specifically claimed, citing Supreme Court precedents Bharat Amaratlal Kothari v. Dosukhan Samadkhan Sindhi (2010) 1 SCC 234 and Union Public Service Commission v. Naseer-Ud-Din Wani (2011) 14 SCC 142.
The Court left open the question of consequential benefits flowing from the quashing of the retirement order (other than reinstatement), directing the parties to bear their own costs.
This judgment underscores the importance of the procedural safeguards in voluntary retirement cases and clarifies that an employee's intention to withdraw such retirement before the effective date must be considered if communicated properly. It also reiterates the principle that constitutional courts must adhere strictly to the reliefs claimed in the writ petition.
Bottom Line:
Voluntary retirement under Rule 50 of the Rajasthan Civil Services (Pension) Rules, 1996 can be withdrawn before the intended date of retirement where acceptance by competent authority is required; request for extension of retirement date made before the effective date amounts to clear intention to continue in service. However, in writ jurisdiction, relief not specifically prayed for, such as reinstatement, cannot be granted.
