Mr. Anuroop Singhi, presiding over the case, noted the lack of direct administrative control by the Department of Law and Legal Affairs over the petitioner, as he is posted with the JDA. The petitioner, represented by Mr. Sunil Samdaria, argued that the charges pertain to actions taken against Mr. Gaurav Kumar Gupta, whose termination from JDA was contested in a separate sub-judice writ petition. Additionally, the second charge-sheet related to a non-compliance issue that is already pending before the court in a special appeal.
The petitioner's counsel emphasized that the termination order had the approval of the JDA Commissioner and cited Section 78 of the Jaipur Development Authority Act, 1982, which provides immunity for actions done lawfully and in good faith.
