Supreme Court Enhances Compensation in Karnataka Road Accident Case

Supreme Court overturns High Court's contributory negligence finding; awards over Rs. 50 lakh to appellant.


In a significant ruling, the Supreme Court of India has enhanced the compensation awarded to Reena, the appellant, following a road accident involving a Karnataka State Road Transport Corporation (KSRTC) bus. The Supreme Court set aside the Karnataka High Court's finding of contributory negligence on the part of Reena's deceased husband, Nandan Shet, and held KSRTC solely liable for the accident.


The accident, which occurred on October 14, 2005, resulted in the deaths of Reena's husband, mother-in-law, and a family friend, while Reena herself sustained serious injuries. Initially, the Motor Accident Claims Tribunal (MACT) attributed the accident solely to the negligence of the KSRTC bus driver. However, the High Court later apportioned 50% of the blame to the deceased driver of the Santro car, which led to a reduction in the compensation awarded.


The Supreme Court, in its judgment, emphasized that contributory negligence should not be determined solely based on site sketches without corroborating evidence. The Court restored the Tribunal's finding of sole negligence by the KSRTC bus driver, based on the FIR, charge sheet, and oral evidence, including the statement of the bus conductor.


The Supreme Court recalculated the compensation, considering the deceased's qualifications and income as a software engineer and entrepreneur. The total compensation awarded to Reena was enhanced to Rs. 50,81,876, with interest at 6% per annum from the date of filing the claim petition until realization. The Court also allowed additional evidence submitted by the appellant to support her claim for higher compensation, highlighting the welfare-oriented nature of motor vehicle accident laws.


This judgment underscores the importance of thorough evidence evaluation in motor accident claims and reaffirms the role of welfare legislation in ensuring just compensation for victims.
