Court Holds Filing Final Report Before Executive Magistrate in Death Cases Violates Statutory Rights; Directs Reports to Judicial Magistrate
In a landmark decision, the Telangana High Court has reiterated the procedural requirements for filing final reports in cases of unnatural deaths, underlining that such reports must be submitted to the jurisdictional Judicial Magistrate of First Class, not the Executive Magistrate. The ruling was delivered by Justice Suddala Chalapathi Rao in response to a writ petition filed by R. Jaya Laxmi, challenging the closure of an FIR related to her husband's accidental death.
The case stemmed from the accidental death of R. Laxman, a BSNL employee, who succumbed to injuries after falling into a negligently left ditch. The petitioner, his widow, contended that the final report was improperly filed before the Mandal Executive Magistrate without due notice or investigation. The court found that this contravened the statutory procedure under the Code of Criminal Procedure (Cr.P.C.) and the Bharatiya Nagarik Suraksha Sanhita, 2023.
Justice Rao emphasized that the filing of a final report before an Executive Magistrate is not contemplated under Section 174 Cr.P.C., which is limited to ascertaining the apparent cause of death. Instead, upon completion of an investigation, the final report should be filed before a Judicial Magistrate of First Class as per Section 173(2) Cr.P.C., now codified as Section 193(3) in the Bharatiya Nagarik Suraksha Sanhita, 2023.
The court cited precedents, including the Madras High Court's ruling in Manohari v. District Superintendent of Police, which supports this interpretation. The Telangana High Court underscored the violation of procedural rights and statutory mandates when the final report is filed incorrectly.
While the petition for reinvestigation was dismissed due to the elapsed time, the court's decision provides crucial guidance on procedural adherence, ensuring that affected parties are duly notified and can exercise their rights within the justice system. This ruling aims to prevent procedural lapses in future investigations of unnatural deaths.
Bottom Line :
Filing of final report under Section 174 Cr.P.C. before Executive Magistrate is not contemplated; final report should be filed before the jurisdictional Judicial Magistrate of First Class under Section 173(2) Cr.P.C.
Statutory provision(s): Section 174 Cr.P.C., Section 173(2) Cr.P.C., Sections 193 and 194 of Bharatiya Nagarik Suraksha Sanhita, 2023
