State Directed to Initiate Acquisition Proceedings for Hospital Construction on Private Land
In a significant ruling, the Telangana High Court has upheld the property rights of private landowners, directing the State of Telangana to compensate the petitioners for the utilisation of their land for constructing the Area Hospital, Bhongir. The court found that the State had taken possession of the land without initiating acquisition proceedings or providing compensation, violating Article 300-A of the Constitution of India.
Justice Vakiti Ramakrishna Reddy presided over the case, where the petitioners, led by Vangeti Satyanarayana Reddy, contended that the land was acquired by them through a validated unregistered document. Despite the absence of Form 13-B, the validation under Section 5-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, was held to confer enforceable rights.
The court emphasized that deprivation of property without lawful authority contravenes constitutional protections. The State's failure to follow due process or provide compensation was deemed unconstitutional, irrespective of the public utility of the hospital.
The judgment mandates the State to initiate acquisition proceedings under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, ensuring payment of compensation with statutory benefits, including solatium and interest, within six months.
Bottom Line :
Deprivation of private property for public use without initiating acquisition proceedings or paying compensation is violative of Article 300-A of the Constitution of India.
Statutory provision(s): Article 300-A of the Constitution of India, Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 Section 5-A, Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
