Tripura High Court Directs Expedited Recruitment of Teachers and Headmasters to Prevent Educational Disruption

Court holds that vacant posts do not lapse due to retirement or resignation and orders immediate filling of 1116 PG teacher posts, 2193 Graduate Teacher posts, and 566 Headmaster positions to safeguard students’ education.


In a significant judgment dated September 9, 2026, the Division Bench of the Tripura High Court, comprising Chief Justice M.S. Ramachandra Rao and Justice Biswajit Palit, has taken suo moto cognizance of the delays in filling vacant teaching and administrative posts in Tripura’s educational institutions. The Court has issued stern directions to the State Government and the Teachers’ Recruitment Board, Tripura, to expedite the recruitment process for a large number of vacant posts to ensure that the education of students is not adversely affected.


The Court observed that a total of 1116 postgraduate (PG) teacher posts have fallen vacant due to retirement, resignation, death, or termination of service. The State Government’s approach of treating these posts as “lapsed” and requiring “re-creation” was found to be legally incorrect. The Court clarified that such posts do not lapse merely because the incumbents vacate them and directed the immediate commencement of recruitment to fill these vacancies.


Similarly, with regard to the 2193 vacant Graduate Teacher posts, the Court noted that the State had only initiated recruitment for 230 posts, without any valid explanation for ignoring the remaining vacancies. The Court emphasized the State’s obligation to fill all such posts to ensure the proper functioning of schools. It was also pointed out that although a Special Leave Petition (SLP) concerning the application of the reservation rule in these recruitments is pending before the Supreme Court, there is no stay on filling these posts. Therefore, recruitment should continue subject to the outcome of the SLP to avoid harming students’ academic progress.


In addition, the Court highlighted the delay in filling 700 newly created Graduate Teacher posts. Despite the Teachers’ Recruitment Board conducting the selection test in February 2026, no subsequent action had been taken. The Court suo moto impleaded the Chairman of the Teachers’ Recruitment Board as a party to the PIL and directed the Board to complete the recruitment process at the earliest, with a compliance affidavit due by the next hearing.


Furthermore, the Court addressed the critical vacancies in school administration, directing the respondents to fill 162 posts of Headmasters and 100 posts of Assistant Headmasters in Higher Secondary Schools, along with 304 Headmaster posts in High Schools. The respondents were mandated to comply with all applicable rules and file affidavits detailing the action taken.


The Court’s intervention aims to prevent the adverse impact on students’ education caused by prolonged vacancies in teaching and administrative positions. The matter has been listed for the next hearing on September 21, 2026, to review compliance with the Court’s directions.


This judgment reinforces that public service posts, especially in education, remain extant notwithstanding vacancies arising from retirement, death, resignation, or termination. It underscores the State’s statutory and constitutional duty to ensure uninterrupted educational services by timely recruitment and filling of vacancies.
