Court Grants Interim Relief to Nikhil Kashyap, Permitting Interview Attendance Pending Petition Outcome

In a significant interim relief, the Delhi High Court has allowed Nikhil Kashyap to participate provisionally in an upcoming interview for a position at the Reserve Bank of India (RBI) without the mandatory submission of an original Experience Certificate. This order was passed by Justice Tejas Karia while hearing a writ petition filed by Kashyap under Article 226 of the Constitution of India, challenging the appraisal report issued by the National Company Law Tribunal (NCLT), New Delhi, and seeking an Experience Certificate for his tenure as a Legal Research Associate.


Kashyap's petition sought multiple reliefs, including the quashing of the appraisal report by the NCLT and a directive for the issuance of an Experience Certificate. The petitioner was slated to appear for an interview on June 25, 2026, for the Non-CSG Cadres position at RBI. The interview call letter required the submission of various documents, including an Experience Certificate from the NCLT and the Comptroller and Auditor General of India (CAG).


The petitioner's counsel argued that the Experience Certificate was crucial for his interview process and contended that the appraisal report issued by the NCLT contained arbitrary observations affecting his candidature. The court, acknowledging the urgency of the situation, issued an interim order allowing Kashyap to attend the interview without the original Experience Certificate, which is subject to the final outcome of the petition.


Respondent No. 3 (RBI) agreed to the provisional participation of the petitioner in the interview, with the condition that, if selected, Kashyap would need to provide the original documents. The court directed RBI to not insist on the original Experience Certificate for the interview scheduled on June 25, 2026, while instructing the respondents to file their counter-affidavits within four weeks, with rejoinders to be submitted two weeks thereafter.


The case is slated for further hearing before the Roster Bench on August 18, 2026. This interim relief marks a crucial juncture for Kashyap as it allows him to proceed with the interview process while the court adjudicates the merits of his petition.
