Allahabad High Court Restores Custody of Minor to Mother in Landmark Judgment

Court Prioritizes Child's Welfare and Education Continuity, Grants Visitation Rights to Father


In a significant decision, the Allahabad High Court has overturned a previous order to grant custody of a ten-year-old girl to her father, restoring it to the mother. The Division Bench, comprising Chief Justice Arun Bhansali and Justice Kshitij Shailendra, emphasized the paramount importance of the child's welfare and her expressed desire to reside with her mother. The court directed that the child's education continuity be maintained while living with her mother.


The judgment came on an appeal filed by Vandana Kapoor against the decision of a Single Judge, which had awarded custody to the father due to concerns about the child's education being disrupted. The mother, a teacher at Heritage School, Gautam Buddh Nagar, had been unable to secure her child's admission there due to the father's refusal to provide a No Objection Certificate (NOC). Despite this, she agreed to continue her daughter's education at Somerville School, where she was previously enrolled, until admission to Heritage School could be secured.


Acknowledging the child's preference to stay with her mother, the court opined that the learned Single Judge should have explored the possibility of continuing the child's education at Somerville School while residing with the mother. The court found that, with the mother's willingness to ensure educational continuity, the basis for transferring custody to the father no longer existed.


In its order, the court also outlined visitation and temporary custody rights for the father. He is entitled to visit the child at her maternal grandparents' house every alternate Sunday for three hours and to have temporary custody during long school vacations for five days at a stretch. Additionally, the father can interact with the child via mobile phone for a reasonable time.


The court mandated that the custody be handed over to the mother by the following day, with police supervision to ensure a smooth transition.
