This was claimed to be a violation of Sections 18 and 36 of the Legal Metrology Act, and Rules 4 and 6(1)(f) of the Legal Metrology Rules. The penalties, however, were deemed arbitrary by the court.
Justice Subba Reddy Satti highlighted that the requirement to declare dimensions under Rule 6(1)(f) arises only if the dimensions are relevant to the transaction or pricing of the commodity, which is not applicable to mobile phones.
