Authorities Ordered to Compensate Petitioner for 'D.P. Road' Used Without Acquisition


In a significant ruling, the Bombay High Court, Circuit Bench at Kolhapur, has reinforced the constitutional and statutory rights of landowners, mandating that authorities must acquire land reserved for public purposes and compensate the landowners accordingly. The decision comes in the case of Zal Sam Cooper v. State of Maharashtra, where the court addressed the misuse of a petitioner's property, reserved for a 'D.P. Road', which was being utilized by the public without any acquisition or compensation.


The petitioner, Zal Sam Cooper, represented by Senior Counsel Mr. Vishwajeet Sawant, sought legal recourse after his attempts to secure compensation for his land were repeatedly denied. The court heard that the petitioner's father had initially sought to develop the land, but a portion was reserved for a 'D.P. Road' in the Satara City's development plan. Despite this reservation, the authorities did not initiate acquisition proceedings or compensate the petitioner, citing fiscal burdens and alleged benefits the petitioner gained from the road.


Delivering the judgment, Justices Vrushali V. Joshi and Sandesh D. Patil noted the authorities' failure to fulfill their statutory obligations under the Maharashtra Regional and Town Planning Act, 1966. The court highlighted that fiscal constraints could not override the landowner's right to fair compensation, a right enshrined as a constitutional, statutory, and human right.


The court dismissed the respondents' arguments regarding delay and laches, recognizing that the petitioner had consistently pursued his claim through various legal avenues. The judgment emphasized that the continuous cause of action and ongoing violation of rights nullified any claims of delay.


In conclusion, the court ordered the State of Maharashtra and the municipal authorities to commence acquisition proceedings and compensate the petitioner in accordance with the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. This ruling underscores the judiciary's commitment to protecting landowners' rights against unjust deprivation of property.
