Thane, Aug 21 The Thane sessions court has acquitted the caretaker and director of an illegal de-addiction center in Mumbra who were accused of 'culpable homicide not amounting to murder' in connection with the death of a 31-year-old inmate in March 2019.
Sessions Judge R D Sawant on Thursday acquitted caretaker Rais Rashid Khan (40) and director Mubin Ahmed Mohammad Hussain Tade (47) of charges under IPC section 304(II), noting that the prosecution failed to prove that the victim's death was homicidal.
The victim, Naim Khan, was admitted to Al Tayebeen De-addiction Center on March 15, 2019, by his father Mohammad Shamim Ramzan Ali Khan. On March 18, Naim sustained a fatal head injury.
The prosecution alleged Naim was tied with iron chains, assaulted, and denied timely treatment.
However, medical evidence showed Naim had a history of drug abuse and multiple falls. The court held that the defense's claim that he fell while washing hands was more probable.
