Family of Late E. Suraj Singh Awarded Rs. 87.17 Lakhs with Interest for Fatal Accident in 2011


In a landmark judgment, the Delhi High Court has significantly enhanced the compensation awarded to the family of E. Suraj Singh, a former member of the Manipur Legislative Assembly, who tragically lost his life in a motor vehicle accident in August 2011. The judgment, delivered by Justice Anish Dayal, has recalibrated the compensation to Rs. 87,17,740, inclusive of interest, from the original amount of Rs. 29,85,000 awarded by the Motor Accidents Claims Tribunal (MACT).


The accident occurred in Delhi when Singh's vehicle collided with a jeep, resulting in fatal injuries. The MACT had previously calculated compensation based on Singh's salary, excluding various allowances. However, Justice Dayal's judgment has included these allowances, such as entertainment, contingency, telephone, and housing allowances, in the computation of Singh's monthly income, thereby increasing the total compensation.


The court's decision was influenced by several precedents from the Supreme Court, which emphasized that income for compensation purposes should encompass allowances and benefits that contribute to the family's welfare. These precedents included rulings from cases such as National Insurance Co. Ltd. v. Indira Srivastava and Vijay Kumar Rastogi v. Uttar Pradesh State Road Transport Co.


Justice Dayal rejected arguments from the insurance company that allowances should be excluded due to the temporary nature of Singh's legislative position. Instead, the court recognized these allowances as integral to the deceased's income and beneficial to the family.


The judgment also directed the enhanced compensation amount to be deposited with the Registrar General of the Court, with specific instructions for disbursement to Singh's legal representatives, ensuring financial security for his wife and children. Additionally, the court has mandated that the remaining amount be placed in fixed deposits to accrue interest, further benefiting the family.


This decision underscores the judiciary's commitment to ensuring fair compensation for victims of motor vehicle accidents, considering not just the salary but the full spectrum of income that supports the dependents' livelihood.
