The Karnataka High Court has significantly enhanced the compensation awarded to Chethana, a 25-year-old accident victim, who suffered grievous injuries and a permanent disability assessed at 100%. Originally awarded Rs. 11,12,187/- by the Motor Accident Claims Tribunal, Kundapura, Chethana's compensation has been increased to Rs. 55,13,187/- by the High Court, taking into account her extensive medical needs and loss of future income due to her inability to work.
The accident occurred on January 27, 2016, when Chethana was traveling as a pillion rider on a motorcycle driven by her husband. The motorcycle lost control and fell, resulting in severe injuries to Chethana, including head trauma and nerve damage. Her treatment involved multiple hospitalizations and surgeries, and she requires ongoing medical care and assistance for daily activities.
The High Court, comprising Justices Jayant Banerji and Tara Vitasta Ganju, recognized the inadequacy of the original compensation, particularly given the appellant's permanent disability and the need for an attendant for the rest of her life. The Court recalculated the compensation using a multiplier method and considered future medical expenses and caretaker charges for 50 years, reflecting her inability to return to her previous occupation as a Post Office Incharge and tailor.
In addition to enhancing the compensation, the Court also revised the interest rate on the awarded amount to 8% per annum, in line with prevailing economic conditions and legal precedents. However, no interest was awarded on caretaker expenses.
The decision underscores the Court's commitment to ensuring just compensation for accident victims, particularly those with life-altering disabilities. The High Court's judgment is a significant development in motor accident claims, highlighting the importance of considering the long-term impact of injuries on victims' lives.
