Delhi High Court Grants Zepto Limited Interim Injunction Against Trademark Infringement

Court restrains defendants from using deceptively similar marks, safeguarding Zepto's brand identity and reputation


In a significant ruling, the Delhi High Court, presided over by Justice Jyoti Singh, has granted an interim injunction in favor of Zepto Limited and its subsidiary, protecting their trademark rights against alleged infringement by Sailendra Kashyap and others. The court's decision comes as a relief to Zepto, a leading player in the quick commerce and logistics sector, as it battles to maintain its brand integrity.


Zepto Limited, known for its rapid commerce services and digital platforms, filed a suit alleging trademark infringement and passing off by the defendants, who were using similar marks, including "ZEPTO FINANCE," for financial services. The plaintiffs argued that the defendants' use of similar marks caused confusion among the public, leading to damage to their reputation and goodwill.


Justice Singh, after reviewing the documents and hearing the arguments, found that Zepto had established a prima facie case for trademark infringement. The court noted the deceptive similarity between the marks used by the defendants and Zepto's registered trademarks, which could mislead consumers into believing there was an association with Zepto.


The court emphasized the extensive use and recognition of Zepto's trademarks in the market, highlighting their significant promotional efforts and widespread consumer base. It acknowledged the plaintiffs' assertion of actual confusion among the public, evidenced by legal notices and complaints received due to the defendants' actions.


In light of these findings, the court restrained the defendants from using the impugned marks or any similar variations that could amount to trademark infringement or passing off. This interim relief will remain in effect until the next hearing scheduled for November 30, 2026.


This ruling underscores the importance of protecting trademark rights in the rapidly evolving digital and commerce landscapes, ensuring that established brands like Zepto can continue to operate without the risk of brand dilution and consumer deception.
