Delhi High Court Quashes Order Against Red Bull India Over "Energy Drink" Label

Court Cites Breach of Natural Justice Principles; Allows Fresh Proceedings with Due Hearing


In a significant ruling, the Delhi High Court has set aside an administrative order preventing Red Bull India Private Limited from using the term "energy drink" on its products. The decision, delivered by Justice Amit Mahajan, underscored the necessity of adhering to principles of natural justice, as the order was issued without prior notice or an opportunity for Red Bull to present its case.


The petitioner, Red Bull India, challenged the directive dated June 30, 2026, which was passed without allowing the company to file a response or provide an explanation. Red Bull, a major player in the energy drink market since 2002, argued that the order posed serious civil consequences, potentially impacting its business operations and the livelihood of its employees.


Justice Mahajan noted that it is a well-settled principle that no statutory authority should pass orders with significant civil implications without providing the affected party an opportunity for representation. He emphasized that the respondents did not demonstrate any extreme emergency that would justify bypassing these procedural safeguards.


In light of these considerations, the Court allowed the petition, thereby nullifying the impugned order and any subsequent actions taken in its wake. However, the respondents have been granted the liberty to issue a fresh order, contingent upon providing Red Bull India with a chance to respond and be heard.


The Court clarified that it has not assessed the merits of the underlying dispute, particularly regarding any potential violations of the Food Safety and Standards Act, 2006, by Red Bull's products. The judgment leaves the door open for the respondents to proceed anew, provided they adhere to the prescribed legal processes.


The ruling reinforces the judiciary's commitment to ensuring fair administrative practices and upholding the rights of parties to due process.
