Court dismisses eviction plea under Delhi Rent Control Act as landlord fails to prove genuine need for premises.


In a significant ruling, the Delhi High Court dismissed an eviction petition filed by Sh. Brij Mohan Batta against Sh. Tara Chand Garg & Anr., citing failure to establish a bona fide requirement for the demised premises. The judgment, delivered by Justice Amit Sharma, underscores the necessity for landlords to present credible evidence of genuine need when seeking eviction under Section 14(1)(e) of the Delhi Rent Control Act, 1958.


The petitioner, Sh. Brij Mohan Batta, sought the eviction of the respondents from a shop in Kirti Nagar, New Delhi, claiming it was needed for his unemployed sons to start a business. However, evidence presented during the trial revealed that his sons were already engaged in a business named 'Om Vaneesa Creations,' operating from another location. This revelation led the court to question the authenticity of the landlord's claimed need for the premises.


The court noted that the petitioner failed to provide sufficient proof to rebut the evidence provided by the tenants regarding alternative accommodations and the ongoing business activities of his sons. Justice Sharma emphasized that the burden of proof lies with the landlord to establish both the bona fide requirement and the absence of a suitable alternative accommodation.


In its judgment, the court also explored the scope of revisional powers under Section 25B(8) of the Delhi Rent Control Act, reaffirming that these powers are limited to reviewing whether the impugned order suffers from any apparent error. The court cannot reappreciate evidence or substitute its own view unless the order is found to be arbitrary, perverse, or vitiated by material impropriety.


The court's decision highlights the importance of a landlord's obligation to demonstrate genuine necessity for eviction, aligning with precedents set by higher courts.
