New Delhi, Aug 17 A Delhi tribunal has awarded Rs 31.7 lakh compensation to a woman whose arm had to be amputated after a car she was travelling in crashed and overturned due to negligent driving in Uttar Pradesh in 2019.
Presiding Officer Manish Sharma was hearing a claim petition filed by Husn Bano Begum and directed Reliance General Insurance Company to pay the compensation along with 9 per cent annual interest from the date of filing of the claim petition.
In an order dated August 7, the Delhi Motor Accident Claims Tribunal said, “This tribunal finds that there is sufficient material on record to establish that the accident had occurred due to rash and negligent driving of the offending vehicle ... and that has caused grievous injuries to the petitioner."
According to the tribunal, petitioner Husn Bano Begum was travelling from Delhi to Bulandshahr in a car on May 22, 2019, when the allegedly speeding vehicle hit a cyclist near Sangat Green Inter College on GT Road and overturned.
She suffered grievous injuries and was later forced to undergo amputation of her upper left arm above the elbow.
The tribunal held that the accident occurred due to the rash and negligent driving of the vehicle by its driver, Faizan Ansari. It noted that the FIR, chargesheet and other material on record supported the claimant's version.
A disability board certified that the woman suffered 80 per cent permanent locomotor disability in her left upper limb. The tribunal assessed her functional disability at 50 per cent, taking into account her work as an embroidery worker.
While computing compensation, the tribunal awarded Rs 12.44 lakh towards loss of future earning capacity and Rs 17.91 lakh towards the cost of an artificial limb and its future replacements.
The judge said that the petitioner had sustained grievous injuries resulting in permanent disability and would face difficulties in carrying out daily activities and enjoying the amenities of life.
The insurer was directed to deposit the award amount within 30 days.
