Court Clarifies Cash Deposit Not Required for Bail Bonds Under Bharatiya Nagarik Suraksha Sanhita, 2023


In a significant decision, the Gauhati High Court has intervened to modify the stringent bail conditions imposed by the Chief Judicial Magistrate, Daporijo, on Shri Anar Ali, a daily-wage earner, who was unable to comply with the conditions due to financial constraints. The judgment, delivered by Justice Budi Habung, emphasizes that bail conditions must not be excessively burdensome or practically incapable of compliance, thus ensuring that the purpose of granting bail is not defeated.


The petitioner, Kamin Taloh, moved the High Court under Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023, arguing that the conditions set by the magistrate were onerous and equivalent to a denial of bail. The Chief Judicial Magistrate had initially ordered the release of Anar Ali on a bail bond of Rs. 2,00,000 with a local surety for the same amount. However, Ali’s inability to fulfill these requirements, due to his status as a simple mason from Assam and not having local sureties, kept him in custody despite being granted bail.


The High Court recognized the petitioner’s plight and the undue hardship caused by the bail conditions. It ordered the modification of the bail requirements, reducing the personal bond to Rs. 50,000 with a surety, which need not be a local resident, subject to identity verification. The judgment also addressed the impermissibility of demanding cash deposits for bail bonds, clarifying that the amount specified in a bail bond does not necessitate a cash deposit.


The Additional Public Prosecutor, Mr. T. Ete, did not oppose the modification, acknowledging the recurring issue across districts in Arunachal Pradesh. The court’s decision draws upon previous rulings, reinforcing that bail is a right and conditions should facilitate compliance rather than obstruct it.


This ruling is a significant clarification under the Bharatiya Nagarik Suraksha Sanhita, 2023, ensuring that economic status does not become a barrier to securing bail. The judgment mandates that the concerned authorities release Ali upon fulfilling the revised bond conditions unless required for other legal proceedings.

Bail conditions must be reasonable and not excessive or onerous, ensuring compliance without frustrating the purpose of granting bail. Cash deposit as a prerequisite for bail is impermissible under law.
