Odedra, J., dismissed a defamation complaint filed by Vijaybhai Jeysingbhai Vasava against Rajeshbhai Ratilal Vasava (Respondent No.2) and others. The petitioner alleged that the respondent had filed a false application with the police regarding a land dispute in Dediyapada Taluka, Narmada District, and further claimed that defamatory statements related to this application were circulated on social media and published in local newspapers to tarnish his reputation.
The petitioner contended that the disputed land was forest land and that the respondent's application was malicious and intended to defame him by accusing him and his associates of illegal cattle grazing on the land. It was further argued that a social media user named Shri Vasava Champak had posted the application and related photographs on Facebook at the behest of the respondent, and newspapers such as Gujarat Samachar and Sandesh had also published defamatory reports.
The trial court, the Additional Chief Judicial Magistrate at Dediyapada, dismissed the complaint under Section 203 of the Criminal Procedure Code (CrPC), citing insufficient evidence to substantiate the defamation claims. The court noted the absence of the original application filed by the respondent on record and observed that the allegations of falsity were matters to be investigated separately. It also highlighted that the newspaper articles did not mention the petitioner's name. Moreover, a civil suit concerning the same land was pending, indicating ongoing legal proceedings on the matter.
The petitioner challenged this dismissal through a revision application, which was also rejected by the District Sessions Judge, Narmada, who concurred with the lower court's findings. The revisional court emphasized that it was premature to determine the truthfulness of the respondent's application at the stage of defamation proceedings and that the petitioner failed to demonstrate that the newspaper reports were published at the respondent's instance.
The Gujarat High Court upheld the decisions of the lower courts, ruling that the essential elements of defamation under Section 500 of the Indian Penal Code (IPC) were not fulfilled. The Court underscored the principle enshrined in Exception 8 to Section 499 of the IPC, which provides that any allegation made in good faith to a person legally authorized to take action does not amount to defamation. Since the respondent's application was filed with lawful authorities concerning a matter within their jurisdiction, it could not be construed as defamatory.
The Court also pointed out procedural deficiencies in the petitioner's case, including failure to produce the original application and not impleading the individual who circulated the alleged defamatory content on social media. Consequently, the Court found no merit in reviving the defamation enquiry.
The judgment reinforces the legal position that filing a complaint or application with competent authorities in good faith, even if it involves allegations against another party, does not constitute defamation. It also highlights the necessity of producing clear and convincing evidence to sustain defamation claims, especially where civil disputes are ongoing.
