Court Orders Appointment of Nitu Kumari as Van Mitra, Emphasizing Legal Missteps in Evaluating Post-Application Changes


In a significant ruling, the Himachal Pradesh High Court has set a precedent by asserting that a candidate's eligibility for recruitment must be assessed based on their status as of the last date of application submission, irrespective of subsequent changes such as marital status. The ruling came in favor of Nitu Kumari, whose candidacy for the position of Van Mitra was unjustly rejected due to a change in her BPL status following her marriage.


Presiding over the case, Justice Ajay Mohan Goel quashed the rejection letter issued to Kumari and directed her appointment with all consequential benefits, including monetary compensation and seniority, effective from the date when other candidates were appointed. The court held that the rejection of Kumari's candidacy was unsustainable in law, as it was based on changes in her personal circumstances after the submission of her application.


The court further clarified that verification of documents during personal interviews should be limited to confirming the correctness of the documents at the time of application. Any changes occurring post-application should not penalize the candidate. It emphasized that there is no legal requirement for a female candidate to remain unmarried during the recruitment process, and such changes should not affect their eligibility.


This ruling came after Nitu Kumari, represented by Advocate Jaidev Thakur, challenged the rejection of her application despite being the most meritorious candidate for the Van Mitra position in the Drang Beat. The rejection was based on her changed BPL status and residency due to marriage, which the court found irrelevant to her eligibility as of the application date.


The court's decision reinforces the principle that eligibility criteria must be strictly adhered to as of the application deadline, setting a benchmark for future recruitment processes. It also underscores the need for recruitment agencies to conclude selection processes expediently to avoid prejudicing candidates due to unforeseen personal changes.


The state, represented by Deputy Advocate General R.P. Singh, argued for the validity of the rejection based on the document verification date. However, the court dismissed this argument, aligning with prior rulings, including one in the case of Kiran Devi v. Himachal Pradesh Staff Selection Commission, which upheld similar principles.


This judgment not only rectifies an individual injustice but also serves as a critical reminder for recruitment bodies to uphold fair practices, respecting the rights of candidates as prescribed by law.
