Notification Limiting Tenure Extension Deemed Contrary to Supreme Court Directives; Immediate Reappointment Ordered
In a significant ruling, the Jharkhand High Court has directed the immediate reinstatement of several members of the District Consumer Disputes Redressal Commissions across the state. This decision comes after a challenge to a state notification that limited the extension of tenure to only those who retired on or after May 21, 2025.
The petitioners, Umesh Singh, Suresh Chandra Jaiswal, Bimal Kumar Lakra, and Chandan Banerjee, had all retired from various positions within the Consumer Disputes Redressal Commissions between September 2024 and February 2025. They argued that the state's notification, which extended tenure benefits only to those who retired after a specified date, was inconsistent with the Supreme Court's directives in the "Limaye-II" judgment.
Justice Deepak Roshan, presiding over the case, noted that the Supreme Court's ruling in "Limaye-II" did not restrict tenure continuation benefits to officeholders retiring after the judgment date. Instead, it mandated that all presidents and members appointed and serving prior to the "Limaye-I" judgment should be allowed to complete their tenure entirely. If their tenure ended before the completion of a new recruitment process, they were entitled to continue until the process was completed.
The court's decision underscores the importance of aligning state actions with Supreme Court directives, thereby ensuring a uniform approach to tenure and reappointment across the country. The High Court modified the impugned notification, affirming that all affected officeholders should be reinstated and allowed to serve until new appointments are made or rules are amended.
This ruling not only benefits the petitioners but also sets a precedent for other similar cases across different states. The court has ordered the state to reemploy the petitioners in their respective posts immediately and to consider the tenure as uninterrupted from their original retirement dates.
