Court quashes pension denial, mandates reconsideration of claim treating FESPIC achievements as equivalent to Asian Para Games under government scheme
In a landmark judgment dated September 2, 2026, the Karnataka High Court has ruled in favor of Sri G Venkataravanappa, a distinguished disabled sportsperson, directing the Ministry of Youth Affairs and Sports and other respondents to grant him pension benefits under the Pension Scheme for Meritorious Sportspersons. The Court held that achievements in the FESPIC Games-a multi-sport event for athletes with disabilities in the Asia-Pacific region-must be considered equivalent to achievements in the Asian Para Games for pension eligibility.
Sri Venkataravanappa, who hails from a remote village in Kolar District and has congenital deformity in both legs, has an illustrious career with multiple international medals, including gold, silver, and bronze at FESPIC Games and other para-sporting events. He is also a recipient of prestigious awards such as the Arjuna Award, Ekalavya Award, and Rajyotsava Award, underscoring his contribution to Indian sports.
Despite fulfilling the eligibility criteria stipulated in the Government of India's pension scheme, which includes medal winners at Olympic, Commonwealth, Asian, and Para-Asian Games, the petitioner's pension application was rejected on the ground that the FESPIC Games were not covered under the Scheme. The respondents took a narrow and hyper-technical interpretation, refusing to equate FESPIC Games with Asian Para Games, which led to denial of pension.
However, the Court emphasized that the Ministry of Youth Affairs and Sports (MYAS) itself has officially recognized that the Asian Para Games superseded the FESPIC Games, resulting in the dissolution of the FESPIC Federation and merger with the Asian Paralympic Committee. A 2023 recommendation by the Paralympic Committee of India also endorsed the petitioner's pension claim based on his FESPIC achievements.
The Court observed that denying pension benefits to Sri Venkataravanappa on the basis of nomenclature alone ignored the substantive equivalence of the events and was contrary to the Ministry's own position. It held that beneficial welfare schemes like the pension scheme must be construed liberally to advance their objectives rather than defeated by unduly technical or inconsistent interpretations.
Quashing the earlier order rejecting the petitioner's application, the Court issued a writ of mandamus directing the respondents to reconsider the pension claim treating the petitioner as a Gold Medalist at the Asian Para Games. The pension is to be granted at the rate of Rs.14,000 per month from the date of the initial application, along with arrears and future payments in accordance with the Scheme. The Court also awarded costs of Rs.25,000 to the petitioner in view of the hardship caused.
This judgment reinforces the principle that sports welfare schemes must be implemented transparently and consistently, ensuring that deserving sportspersons, especially those with disabilities, are not deprived of their rightful benefits due to hyper-technical interpretations or procedural lapses. It sends a strong message to administrative authorities to align their decisions with the stated objectives of such schemes and the recognized positions of the concerned ministries and sporting bodies.
