Court Finds No Grounds for Communal Charges; Investigation Temporarily Halted


In a significant ruling, the Karnataka High Court has granted interim relief to Kiran R, a law student embroiled in legal troubles following a tweet linked to a tragic incident. The tweet, which followed the daylight murder of a young woman at the Bantwala bus stand, led to the registration of two criminal cases against Kiran R under sections of the Bharatiya Nyaya Sanhita, 2023, and the Indian Penal Code.


The tweet described the assailant in a manner that some construed as communal, prompting charges under sections 192 and 353(2) of the Bharatiya Nyaya Sanhita, 2023, and sections 153A and 505(2) of the Indian Penal Code. However, Justice M. Nagaprasanna observed that the tweet lacked any explicit or implicit references targeting a specific religion, community, caste, or identifiable group.


The court's decision drew heavily on precedents, including the Supreme Court judgments in "Bilal Ahmed Kaloo v. State of A.P.", "Javed Ahmad Hajam v. State Of Maharashtra", and "Patricia Mukhim v. State Of Meghalaya". These cases emphasize the necessity of clear evidence of intent to incite communal hostility or hatred for the application of the aforementioned legal provisions.


The prosecution, represented by the State Public Prosecutor, argued against the relief, citing the nascent stage of the investigations. Nonetheless, the court found that neither the tweet's language nor its context supported the allegations of communal disharmony, leading to a stay on further investigation until a more detailed examination could occur.


This interim order halts all investigative proceedings in connection with the cases registered in Crime No.100 of 2026 at Bantwala Police Station and Crime No.108 of 2026 at High Grounds Police Station, Bengaluru, until August 7, 2026, when the matter will be revisited.
