In a significant development, the Karnataka High Court has set aside an earlier order by the Customs Authority for Advance Rulings (CAAR) and remitted the matter back for reconsideration. The case involves Halton India Private Limited, a company engaged in ventilation solutions, which had contested the classification of its imported kitchen exhaust hoods under the Customs Tariff.
The Division Bench, comprising Justices S.G. Pandit and Dr. K. Manmadha Rao, heard the appeal filed by Halton India against the CAAR's decision. The company sought to reclassify its kitchen exhaust hoods under a different tariff heading, arguing that the products contained fans and should be categorized under the Customs Tariff Heading (CTH) 84145990 - Others, which pertains to ventilating or recycling hoods incorporating a fan.
The appellant's counsel, Sri Pradyumna G. H., contended that due to a bona fide error, additional documents supporting their claim were sent to an incorrect email address and were not considered by the CAAR in its original ruling. In contrast, the counsel for the respondents, Sri Aravind V. Chavan, argued that the CAAR had made a definitive finding based on the materials initially provided by Halton India.
Upon reviewing the arguments and materials, the High Court concluded that the CAAR should reassess the case after considering the additional evidence. The court emphasized the necessity of justice and fairness, allowing Halton India to furnish the additional documents within 15 days.
