Court Impleads Secretary to Government for Effective Compliance with Writ Judgment, Citing Telangana’s Model for Comprehensive Survey
In a significant directive, the Kerala High Court has ordered additional measures for compliance with an earlier judgment concerning a socio-economic caste survey. This directive came during the hearing of Contempt Case(C) No. 2097 of 2026(S) in WP(C) 19937 of 2019, involving the Minority Indians Planning and Vigilance Commission Trust as the petitioner against Shri. Jatin Chopra and others.
The court, presided over by Chief Justice Soumen Sen and Justice Syam Kumar V.M., addressed the issues related to the execution of a socio-economic caste survey aimed at aiding the educational, social, and economic advancement of backward classes in Kerala. The Director of the Backward Classes Development Department, Mr. Renjith D. IAS, appeared before the court, stating that his role was limited to implementing schemes and that he lacked the authority to independently initiate such a survey.
The court recognized the necessity of including the Secretary to the Government, Department of Backward Classes Development, as an additional respondent to ensure effective compliance with the earlier judgment. Consequently, Dr. Veena N. Madhavan (IAS) has been impleaded and directed to file an affidavit within four weeks detailing the steps taken towards conducting the survey.
Highlighting the importance of comprehensive data collection, the court referenced a government order from Telangana, which had successfully conducted a door-to-door household survey covering socio-economic, educational, employment, political, and caste aspects. The Kerala High Court has requested the Additional Advocate General to evaluate this model and consider its implementation in Kerala.
The case is scheduled for further hearing on November 5, 2026. Meanwhile, the court has temporarily dispensed with the personal appearance of the second respondent.
