Madhya Pradesh High Court Upholds Limited Liability of Insurance Company in Road Accident Case

High Court affirms Insurance Company's liability limited to Rs. 1,00,000 per passenger; Enhances compensation for claimants in line with Supreme Court guidelines.


In a significant ruling, the Madhya Pradesh High Court, Indore Bench, has upheld the limited liability of United India Insurance Co. Ltd. in a road accident case involving the M.P. State Mining Corporation Ltd. The court ruled that the insurance company's liability is confined to Rs. 1,00,000 per passenger, as stipulated in the terms of the policy, despite the policy being labeled as a Comprehensive/Package Policy.


The case arose from a tragic accident on February 20, 2012, when a car carrying Ravindra Shah and others met with an accident due to alleged rash and negligent driving. The accident resulted in Shah's death and injuries to other occupants. The deceased's family filed a claim for Rs. 1,25,00,000, but the Motor Accident Claims Tribunal initially limited the insurance company’s liability to Rs. 1,00,000, sparking appeals from both the corporation and the claimants.


M.P. State Mining Corporation Ltd., the vehicle owner, argued that the Comprehensive Policy should cover the full compensation, citing an IRDA circular mandating such coverage. The claimants also supported this view, seeking enhanced compensation.


However, the insurance company contended that the premium paid only covered a liability of Rs. 1,00,000 per passenger. The court, referencing Supreme Court judgments in C.M. Jaya and Balakrishnan cases, confirmed that without a higher premium, the liability is limited to the policy terms.


In a partial victory for the claimants, the court did enhance the total compensation to Rs. 37,62,833 from the tribunal's award of Rs. 28,86,616, in line with the Supreme Court's Pranay Sethi guidelines. The enhancement includes considerations for future prospects, loss of estate, funeral expenses, and consortium.


The High Court dismissed the appeal by M.P. State Mining Corporation Ltd. and partially allowed the claimants' appeal for enhanced compensation, maintaining the interest rate at 6%.


Bottom Line :

Determination of the liability of the Insurance Company under a Comprehensive/Package Policy for compensation to occupants of a private car, based on the terms and conditions of the policy and payment of premium.
