Interim Injunction Issued Against Unlawful Broadcasting of Upcoming Film "BHOOTAM BHAYAM"


In a significant development, the Madras High Court has granted an interim injunction to Zee Entertainment Enterprises Ltd. to prevent the unauthorized broadcasting of its upcoming cinematographic film "BHOOTAM BHAYAM." The order was issued by Justice K. Kumaresh Babu, who presided over the matter, focusing on the potential copyright infringement concerns raised by the applicant.


The case was filed by Zee Entertainment against various Internet service providers and cable TV operators, seeking to restrain them from unlawfully broadcasting the film, which is scheduled for release on July 24, 2026. Zee Entertainment substantiated its claim by presenting the Central Board of Film Certification (CBFC) certificate, which identifies Zee as the film's producer, along with promotional materials for the film.


The court recognized the likelihood of irreversible damage if the unlawful broadcasting were not curtailed. However, it also took into consideration the legitimate business interests of the respondents. As a result, the court granted a four-week ad interim injunction, with the stipulation that Zee Entertainment must indemnify the respondents for any potential legitimate business losses incurred during this period.


The court's decision underscores the balance it seeks to maintain between protecting intellectual property rights and ensuring that legitimate business activities are not unduly hampered. The order mandates that notices be served to the respondents and permits private notice through Speed Post with Acknowledgment Due. Zee Entertainment is required to comply with Order XXXIX Rule 3 of the Code of Civil Procedure, which pertains to the issuance of injunctions.


The matter is scheduled to be revisited after four weeks, at which point the court will evaluate any developments and decide on further proceedings.
