Court Dismisses Appeal After Respondent's Remarriage During Pendency of Case


In a significant ruling, the Madurai Bench of the Madras High Court, presided over by Justices G.R. Swaminathan and M.D. Sumathi, upheld a Family Court's decision to grant divorce on grounds of cruelty and desertion under the Hindu Marriage Act, 1955. The case, brought forth by J.R. Lekha @ Vennila against her husband R. Muthukumar, has gained attention for its implications on post-divorce remarriages pending appeal.


The marriage, solemnized in 2001, faced turmoil due to allegations from Muthukumar doubting Lekha's character. This was deemed by the court as cruelty under Section 13(1)(i-a) of the Hindu Marriage Act. Additionally, Muthukumar's indifference and failure to maintain their two children were interpreted as constructive desertion, justifying the divorce under Section 13(1)(i-b).


The appeal, filed by Muthukumar against the Family Court's decision, was further complicated by Lekha's remarriage during the pendency of the appeal. The court noted that despite the appeal being filed within the limitation period, no interim stay was granted on the divorce decree, allowing Lekha to remarry legally.


Referencing several Supreme Court judgments, the bench highlighted that a marriage contracted post-divorce, without an interim stay, cannot be deemed void. The court suggested an amendment to Section 15 of the Hindu Marriage Act to clarify the conditions under which remarriage is permissible during an appeal.


The judgment dismissed Muthukumar's appeal as infructuous, emphasizing the need for legislative clarity on remarriages during pending appeals to avoid similar legal ambiguities in the future.
