NGT seeks response from CAQM, others on builder's plea against closure notice

New Delhi, Jul 8 The National Green Tribunal has sought responses from the Commission for Air Quality Management (CAQM) in the National Capital Region and adjoining areas, and others on an appeal filed by a Haryana-based construction company challenging a closure notice.


The green body was hearing a plea by Ramakrishna Buildwell Pvt Ltd challenging the CAQM’s closure notice issued on April 30 this year.


In an order dated July 6, a bench of NGT Chairperson Justice Prakash Shrivastava and expert member Afroz Ahmad noted that the company's advocate submitted that the closure notice had earlier been challenged before the Punjab and Haryana High Court, which was dismissed as withdrawn on June 3.


The tribunal noted that the high court had granted interim protection against the disconnection of electricity for 15 days. According to the company's counsel, that protection has since expired, and the power connection has been disconnected.


"Issue notice to the respondents," the tribunal said.


The respondents or parties in the matter are CAQM, Haryana State Pollution Control Board and Uttar Haryana Bijli Vitran Nigam Ltd.


"Let reply be filed by these respondents within two weeks,” said the tribunal, posting the matter on August 11 for further proceedings.
