In a significant ruling, the Punjab and Haryana High Court has quashed a show cause notice issued by the State of Punjab after it was found that the notice was prepared using an Artificial Intelligence (AI) tool without the requisite independent application of mind by the competent authority. The decision, delivered by a division bench comprising Ashwani Kumar Mishra, ACJ, and Rohit Kapoor, J., underscores the necessity for human oversight and deliberation in administrative actions, especially those involving legal proceedings.
The case, titled M/s. SRO India v. State of Punjab, revolved around a show cause notice (DRC-01A) issued on February 2, 2025, which M/s. SRO India challenged on the grounds that the competent officer relied on AI tools instead of independently examining the facts and applying their own judgment. The petitioner argued that the use of AI in this manner contravened statutory requirements, which demand that the issuing authority personally engage with the case details.
The judgment highlighted that statutory provisions mandate competent authorities to independently assess and apply their minds to the facts before issuing a show cause notice. The court found that the AI tool's use in crafting the notice lacked legal sanction and, therefore, invalidated the notice and subsequent proceedings.
The court was not persuaded by the respondent's explanation that AI references were inadvertently uploaded, stressing the statutory obligation for human involvement. Consequently, the issued show cause notice and related proceedings were nullified. However, the court granted the competent authority the liberty to issue a fresh order, provided it is done with proper consideration and independent judgment in accordance with the law.
