Tehsildar and Patwari Suspended for Failing to Remove Encroachments; Immediate Action Ordered by Court
In a stern directive issued by the Rajasthan High Court, the Jaipur Bench has ordered immediate departmental action against two revenue officials for failing to comply with court orders regarding the removal of encroachments. The court has directed the suspension of Mr. Deen Dayal Sharma, Tehsildar, Nadoti, Karauli, and Mr. Bharat Singh Gurjar, Patwari, Nadoti, Karauli, until the conclusion of departmental proceedings.
This decision comes after repeated court orders were ignored, resulting in continued encroachments. The court's previous orders, dated April 27 and April 30, 2026, had demanded the removal of encroachments by April 30, 2026, with a requirement for a compliance report. However, the officials failed to meet these directives, prompting the court to take firm action.
The bench, led by Mr. Sanjeev Prakash Sharma, ACJ, and Mr. Maneesh Sharma, J., expressed shock and disappointment at the officials' admission that encroachments persisted, despite multiple removal attempts. The court noted the officials' lack of regard for judicial orders and their apparent dereliction of duty.
While the court refrained from initiating contempt proceedings, it emphasized the need for accountability and directed the Revenue Secretary to initiate immediate departmental action. Additionally, the court instructed the Additional Advocate General, Mr. G.S. Gill, to ensure that the Station House Officer (SHO) and other revenue authorities promptly remove the encroachments and submit a compliance report before the next hearing on July 8, 2026.
The court has also mandated the removal of any additional encroachments that may be discovered, signaling its determination to restore compliance with legal directives and uphold the rule of law.
Bottom line:-
Departmental action and suspension of officials for non-compliance of court orders regarding removal of encroachments.
Statutory provision(s):
1. Departmental action and suspension of officials
2. Court orders regarding encroachments
3. Compliance with judicial directives
