Despite efforts by the court to mediate reconciliation between the estranged couple, Smt. Wajeehah Wajahat expressed her unwillingness to resume cohabitation, citing harassment and cruelty.

While the mother is currently dependent on her father and not gainfully employed, the father demonstrated his capacity to support the children, with evidence of stable income and adequate living conditions.

The court ruled that the children's welfare would be best served by placing them in their father's custody, given the current circumstances.


However, the court took care to preserve the maternal relationship. Smt. Wajeehah Wajahat was granted visitation rights every Sunday and daily interaction through video conferencing. The court directed both parents to act maturely and refrain from making adverse statements about each other in the presence of the children, ensuring the arrangement supports the children's emotional well-being.


The judgment reaffirms the legal principle that child welfare is the ultimate consideration in custody matters, surpassing parental rights.
