Court Imposes Rs. 10,000 Costs for Abuse of Process, Directs Payment to Legal Services Committee


In a notable judgment, the Andhra Pradesh High Court has dismissed a writ petition for habeas corpus filed by a husband seeking the custody of his wife, who he alleged was under illegal detention by her father. The court, comprising Justices Ravi Nath Tilhari and Purushottam Kumar Chintalapudi, declared that the matter was a matrimonial dispute rather than a case of illegal detention, and thus, the remedy did not lie in filing a writ of habeas corpus.


The case, titled "Pilli Venkata Chinni Krishna v. State of Andhra Pradesh," involved the petitioner, Pilli Venkata Chinni Krishna, who sought legal intervention claiming that his wife, Morthala Rohini, was being unlawfully detained by her father. However, the court noted that the wife, on previous occasions, had expressed her willingness to stay with her parents and had returned to her matrimonial home of her own free will, only to leave again.


The bench observed that such circumstances did not constitute illegal detention and were indicative of a matrimonial dispute. The court emphasized that the filing of successive writ petitions in this context amounted to an abuse of the court's process and a waste of precious public time. Consequently, the court imposed costs of Rs. 10,000 on the petitioner, directing the amount to be paid to the Andhra Pradesh High Court Legal Services Committee.


The decision was delivered on July 30, 2026, in W.P. No. 20367 of 2026. The court also ordered that the costs be paid within three weeks, failing which necessary steps would be taken to realize the costs. The matter has been scheduled for further listing on August 25, 2026, solely to verify compliance with the court's order regarding the payment of costs.


Bottom Line :

Filing successive writ petitions for Habeas Corpus in a matrimonial dispute where there is no illegal detention amounts to abuse of the process of the Court and wastes precious public time.
