Court Orders Revision of Compensation Calculations to Ensure Compliance with Simple Interest Mandate


In a significant judgment, the Nagpur Bench of the Bombay High Court has directed a recalibration of compensation calculations in a land acquisition case involving the Maharashtra Industrial Development Corporation (MIDC). The decision, delivered by Justice Rohit W. Joshi, mandates the application of simple interest on the enhanced compensation awarded for land acquisition, setting aside the practice of compounding interest, which was previously applied.


The case, titled Maharashtra Industrial Development Corporation v. Mohan Shriram Nimdeokar, revolved around the correct calculation of interest on enhanced compensation following the acquisition of land under the Maharashtra Industrial Development Act, 1961. Initially, the landowner, Mohan Shriram Nimdeokar, was awarded compensation for both the land and the trees upon it. However, dissatisfied with the compensation, he sought a reference for enhancement, which eventually resulted in increased compensation.


The crux of the legal contention was the calculation of interest under Section 28 of the Land Acquisition Act, 1894. The Court emphasized that the interest should be computed as simple interest on the enhanced amount of compensation, which includes solatium and a 12% interest component, thereby rejecting the practice of compounding interest on unpaid amounts.


The judgment further quashed previous orders issued by lower courts that compounded interest on the outstanding balance of compensation. It remitted the case to the Executing Court for fresh calculation of the amount payable to the landowner, strictly adhering to the principle of simple interest.


In its reasoning, the Court underscored that both the MIDC and the respondent landowner had mistakenly compounded interest in their calculations, leading to inaccuracies. The Court also noted that the Registrar’s earlier reports contained similar errors, which were subsequently corrected.


The decision highlights a critical interpretation of Section 28 of the Land Acquisition Act, reinforcing that interest must be calculated on the enhanced compensation amount as simple interest, without any compounding. This interpretation aims to provide clarity and consistency in compensation calculations in land acquisition cases.


The Court has directed the Executing Court to determine the correct compensation amount by October 31, 2026, ensuring compliance with the outlined principles.
