Court affirms that recovery of compensation must adhere to statutory procedures, quashes withholding of contractor’s deposit.
In a landmark judgment, the Jammu & Kashmir and Ladakh High Court has reaffirmed the principle that statutory and contractual procedures must be strictly adhered to in the recovery of compensation payments. The Division Bench, comprising Justices Mrs. Sindhu Sharma and Shahzad Azeem, delivered the verdict on August 18, 2026, dismissing an appeal by the Union Territory of J&K against the decision of a Single Judge which quashed the withholding of a Call Deposit Receipt (CDR) belonging to contractor Gulzar Ahmad Wagra.
The case revolved around a contract awarded to Wagra for constructing a sewer line at Nigeen. Despite various challenges in executing the project, including land acquisition issues and objections from local stakeholders, Wagra's CDR of Rs. 2,24,750 was withheld by the authorities. The authorities argued that the withholding was justified to indemnify the compensation they paid under the Workmen's Compensation Act, 1923, for a separate incident involving the death of two laborers on another project handled by Wagra.
The High Court, however, held that the principal employer, the Union Territory of J&K, lacked the statutory or contractual authority to unilaterally withhold funds related to an independent contract as a means of indemnification. The court emphasized that any claim for recovery must follow legally recognized procedures and cannot be executed through arbitrary actions.
Citing precedents from the Supreme Court, including the cases of Union of India v. Raman Iron Foundry and M/S Gangotri Enterprises Limited v. Union of India, the court reiterated that claims for unliquidated damages do not transform into a debt until adjudicated by a competent authority. The judgment reaffirmed that the appellants must pursue their recovery claims through appropriate legal channels rather than resorting to unauthorized deductions from unrelated contracts.
The court's decision affirms the earlier judgment of the Single Judge, directing the release of the withheld CDR to Wagra while leaving open the possibility for the appellants to pursue other legal remedies for recovery if applicable.
