Medical Cause of Death Does Not Negate Liability; Case Remanded for Compensation Assessment to Family of Deceased Passenger


In a significant judgment delivered on September 10, 2026, the Delhi High Court clarified that a death resulting from an accidental fall inside a moving train qualifies as an "untoward incident" under Section 123(c)(2) of the Railways Act, 1989, regardless of the medical cause of death. The judgment, authored by Justice Manoj Kumar Ohri, overturned a previous ruling by the Railway Claims Tribunal which had dismissed a compensation claim citing myocardial infarction as the cause of death.


The case arose from the tragic demise of Sanjeev Kumar, a bona fide passenger traveling on Train No. 64157 (Etawah-Agra Cantt. Shuttle MEMU) on November 10, 2015. According to evidence, Sanjeev Kumar fell from the upper berth inside the moving train due to a sudden jerk while nearing Agra Cantt. Railway Station. Although he was immediately attended to by the railway doctor, he was pronounced dead shortly thereafter. The post-mortem report recorded the cause of death as "shock resulting from myocardial infarction."


The deceased's father, Shyam Singh, along with other contemporaneous documents such as the Deputy Station Superintendent's memo and the panchnama prepared at the time of the incident, firmly established that an accidental fall had indeed occurred inside the train. Despite this, the Railway Claims Tribunal had rejected the family's claim on the ground that the death was due to natural causes and not an "untoward incident" under the Railways Act.


The High Court, however, found fault with the Tribunal's approach of relying solely on the medical cause of death while disregarding the factual evidence of the fall. Citing precedents including the Supreme Court's ruling in Union of India v. Prabhakaran Vijaya Kumar (2008) and the Delhi High Court's own decision in Union of India through General Manager, Northern Railway v. Triveni, the court emphasized that the legal interpretation of "untoward incident" must be broad and purposive. The Court stated that an accidental fall inside the train, caused by the sudden jerks of a moving train, squarely fits within the statutory definition and triggers the principle of strict liability under Section 124-A of the Railways Act.


The Court further observed that the medical finding of myocardial infarction as the cause of death did not negate the occurrence of the fall or the railway's liability. It highlighted that no conclusive evidence was presented to prove any pre-existing heart condition of the deceased. The fact that the deceased was traveling for treatment of back pain was insufficient to infer a cardiac ailment. Thus, the fatal injury was likely precipitated by the fall.


Consequently, the Delhi High Court set aside the Tribunal's judgment and remanded the matter for reassessment of compensation to be awarded to the appellants, i.e., the deceased's family. The Tribunal was directed to expedite the compensation process and ensure disbursement within two months from receiving the order.


This ruling reinforces the principle that railway passengers are protected under a no-fault liability scheme for accidents occurring during travel, including falls caused by jerks inside moving trains. The judgment clarifies that railway authorities cannot escape compensation liability merely by attributing death to medical causes if an accidental fall or similar untoward incident has been established.
