In a significant judgment delivered on September 1, 2026, the Himachal Pradesh High Court (Division Bench) in the case of Ishan Dogra vs. State of Himachal Pradesh & Ors. overturned the earlier dismissal of a writ petition concerning the selection process for the post of `Van Mitra'. The Court found that the appellant, Ishan Dogra, had been wrongly excluded from appointment despite securing higher marks in a revaluation examination, which legally relates back to the date of the original examination.
The controversy arose during the recruitment for the post of `Van Mitra' in the Mashnoo beat of Kinnaur district. The appellant initially submitted a marks certificate dated April 22, 2019, showing 390 out of 500 marks. However, after appearing in an improvement (revaluation) examination, he obtained a revised certificate dated June 27, 2019, reflecting 409 marks. The authorities, however, relied only on the first certificate for eligibility and selection, leading to the appointment of another candidate with lower marks (79%) compared to the appellant's improved score (81.1%).
The Single Judge had dismissed the appellant's writ petition on the ground that he had not disclosed the existence of the improved certificate at the time of application and imposed a cost of Rs. 5000 on him. On appeal, the Division Bench comprising Chief Justice G. S. Sandhawalia and Justice Chirag Bhanu Singh held that the improved marks obtained in revaluation must be considered as relating back to the original examination date for eligibility purposes. The Court emphasized that the authorities erred in not considering the updated certificate, which led to an incorrect selection decision.
The Court relied on precedents including the Punjab and Haryana High Court's decision in Nidhi Sharma vs. Guru Nanak Dev University (2004), Haryana Public Service Commission vs. Sandeep Sharma (2021), and the Supreme Court's ruling in Dolly Chhanda vs. Chairman, JEE (2004). The Apex Court had clarified that while eligibility qualifications must be possessed by the cut-off date, some procedural relaxations in submission of proof may be allowed depending on the facts.
Acknowledging the legal position, the Court directed the State to appoint the appellant to one of the two vacant `Van Mitra' posts available in the Rampur Forest Circle under Kinnaur Division. The appointment was ordered with relaxation of the requirement that the candidate must be a resident of the local Gram Panchayat or Urban Local Body. The appellant, a resident of Rampur adjoining Kinnaur, had expressed willingness to serve in these posts. The State was directed to complete the appointment process within four weeks, with service benefits accruing only from the date of appointment order and without seniority rights.
Furthermore, the Court set aside the Rs. 5000 cost imposed by the Single Judge and ordered refund if already deposited. The appeal was thus allowed, ensuring fairness in the recruitment process and upholding the legal principle that improved examination results must be factored in for eligibility and selection.
This judgment reinforces the principle that revaluation or improvement results should not be disregarded if issued before the final cut-off date, and procedural strictness should not lead to injustice in public appointments.
