Court Directs Local Authorities and Community to Collaborate in Improving Facilities at Village Kotari's Sole School
In a landmark decision underscoring a constructive approach to public grievances, the Madhya Pradesh High Court, Jabalpur Bench, dismissed a Public Interest Litigation (PIL) that sought the closure of a private school in Village Kotari, District Umaria, citing inadequate infrastructure. The court, presided over by Justices Vivek Rusia and Pradeep Mittal, emphasized the importance of maintaining the sole educational institution in the area by addressing infrastructural deficiencies through community cooperation rather than shutting it down.
The case, filed by social activists Manggi Bai Kole and others, highlighted the dire conditions at Devarsi High School, including lack of basic amenities such as toilets, drinking water, and adequate seating arrangements. The petitioners, who are also local governing body members, presented reports from the Block Education Officer and spot inspections that confirmed the school's unsatisfactory and unsafe conditions.
Instead of accepting the petitioners' plea to withdraw the school's recognition, the court directed the Gram Panchayat and local authorities to take proactive steps to rectify the situation. The judgment emphasized a systematic and cooperative effort involving all stakeholders, including villagers and petitioners, to improve the school's infrastructure, thereby safeguarding the academic future of local children.
The court highlighted that extreme actions, such as closing the school, would jeopardize students' education since no alternative government school exists in the Gram Panchayat. It urged local leaders to convene a General Body Meeting to devise a resolution for overcoming the deficiencies, thereby promoting a constructive approach in handling PILs.
This decision is a significant step towards ensuring educational access in rural areas while promoting community involvement in public welfare. The court has tasked the petitioners with filing a compliance report, showcasing the efforts taken to meet the court's directives.
Bottom line:-
Public Interest Litigation - Private school lacking basic infrastructure facilities - Instead of shutting down the school or withdrawing its recognition, systematic and cooperative efforts should be made to eliminate deficiencies in public interest to ensure the academic future of local children is not jeopardized.
